How the points work

You start with 12 points (art. 121.º-A, n.º 1). A further 3 points every 3 years without serious or very serious offences or crimes, up to a maximum of 15 (art. 148.º, n.º 5; 121.º-A, n.º 2).

  • Serious offence (contraordenação grave): −2 (art. 148.º, n.º 1, a)).
  • Serious offence involving alcohol, mobile phone, speeding in a shared-space zone (zona de coexistência) or overtaking immediately before or on a pedestrian crossing: −3 (art. 148.º, n.º 1, a)).
  • Very serious offence (contraordenação muito grave): −4 (art. 148.º, n.º 1, b)).
  • Very serious offence involving alcohol, drugs or speeding in a shared-space zone: −5 (art. 148.º, n.º 1, b)).
  • Criminal offence with a driving ban: −6 (art. 148.º, n.º 2).

Several serious and very serious offences on the same day take off a maximum of 6 points, except those involving alcohol or drugs, which are always deducted (art. 148.º, n.º 3).

  • With 5 points or fewer: a road safety training course is compulsory (art. 148.º, n.º 4, a)).
  • With 3 points or fewer: you have to retake the theory part of the driving test (art. 148.º, n.º 4, b)).
  • With no points: your licence is revoked (cassada) and you can only get another one 2 years later (art. 148.º, n.º 4, c) e n.º 11).

Minor offences carry a fine only. Serious and very serious offences also carry a driving ban: from 1 month to 1 year for serious ones and from 2 months to 2 years for very serious ones (art. 147.º, n.º 2).

New licence. In the first 3 years of holding a licence (probationary regime, regime probatório), the alcohol limit is 0.2 g/l, and a conviction for a road crime, for a very serious offence or for a second serious offence makes the licence lapse; it can only be recovered with a special test (arts. 81.º, n.º 3; 122.º, n.º 1; 130.º, n.º 1, c) and n.º 4, a)).

Paying the minimum. You can pay the fine at the minimum amount within 15 working days of being notified. For serious and very serious offences, the proceedings continue to decide on the driving ban. (art. 172.º, n.º 1, n.º 2 e n.º 4).
